Privacy Statement

Identity
Yourtrademarkregistration is a trademark and trade name of Law Fathers IP B.V. LegalMatters.com B.V., with its registered office at Danzigerbocht 23, Amsterdam (1013 AM), registered with the Chamber of Commerce under number 66741904, attaches great importance to your privacy. This Privacy Statement provides information about the processing of personal data by or on behalf of LegalMatters, in accordance with the General Data Protection Regulation (GDPR).

What personal data does LegalMatters process?
We may process: name and contact details, data required for handling disputes or legal advice, bank account numbers, data from public sources (Trade Register, Land Registry, Municipal Personal Records Database), and other data required by law. For job applicants, we also process CV data, cover letters, diplomas and interview notes. For suppliers, we process order and payment data.

Legal grounds and purposes
We process personal data only on legal bases set out in the GDPR: (1) necessity for the performance of the contract, (2) legal obligation, (3) legitimate interest, or (4) consent. Purposes include providing legal services, administration, communication, procurement, internal controls, compliance, processing job applications, and operating our website.

With whom do we share personal data?
We only share personal data with third parties where necessary for the described purposes, where required by law, or with your consent. Data sharing is done under strict conditions, including a data processing agreement where required under the GDPR.

Retention
LegalMatters does not retain personal data longer than strictly necessary for the purposes for which it was collected, or to comply with legal obligations.

Storage
We aim to process personal data exclusively within the European Union. In the rare cases that data must be transferred outside the EU, appropriate protective measures are in place.

Security
LegalMatters implements appropriate technical and organisational measures to prevent loss, misuse, unauthorised access or alteration. For concerns, contact us at info@legalmatters.com.

Your rights
You have the right of access, rectification, restriction, erasure, data portability, withdrawal of consent, and the right to lodge a complaint with the Dutch Data Protection Authority. Requests can be submitted to info@yourtrademarkregistration.com. We will respond within one month.

Minors
Our services are not aimed at minors. If you believe we have collected personal data about a minor without parental consent, contact us at info@yourtrademarkregistration.com and we will delete this information.

Changes
We reserve the right to make changes to this Privacy Statement. Substantial changes will be announced on our website.

General Terms & Conditions

1. These General Conditions are available for inspection at the reception of LegalMatters.com B.V.'s office at Danzigerbocht 23, Amsterdam (1013 AM) and at www.yourtrademarkregistration.com.
2. Yourtrademarkregistration is a trademark and trade name of Law Fathers IP B.V. LegalMatters.com B.V. is the licensee of this trademark and trade name.
3. LegalMatters.com B.V. is a private company with limited liability according to Dutch law. A list of shareholders will be provided at first request.
4. These General Conditions apply to all services provided by or on behalf of LegalMatters.com B.V., in any capacity. All General Conditions of clients and/or contractors are excluded. To the exclusion of Sections 7:404, 7:407(2) and 7:409 of the Dutch Civil Code, all engagements are accepted and carried out solely by LegalMatters.com B.V.
5. LegalMatters.com B.V.'s general conditions also apply to all professional corporations with which LegalMatters.com B.V. has a management agreement, their managing directors and shareholders, and all employees, former employees and other affiliated persons and their heirs.
6. Quotations: All amounts are exclusive of VAT and are indicative. They do not include costs for activities unrelated to standard filing (such as translations, opposition proceedings or refusal responses), which are invoiced hourly. Prices are subject to changes in official duties, taxes and exchange rates.
7. Currency & exchange rates: Prices on this website are stated in euros (EUR). Where the website displays converted amounts in other currencies, these conversions are provided for indicative purposes only. No rights may be derived from displayed currency conversions. Exchange rates fluctuate and are updated periodically; the conversion shown at any given moment may differ from the rate applicable at the time of invoicing. The euro amount stated in the quotation or invoice is binding.
8. If LegalMatters.com B.V. supervises a subsidy process, a one-time fee of 20% over the total subsidy received by the Client is charged.
9. Monitoring: A monitoring subscription is activated upon receipt of payment and renews automatically each year unless cancelled in writing by registered mail two months before expiration.
10. Domain name registration: Domain name registrations are valid for one year, activated upon payment, and renewed annually unless cancelled in writing by registered letter two months before expiration.
11. Idea registration: An idea registration provides a date stamp as legal evidence, kept for 5 years. LegalMatters.com does not guarantee copyright protection, as this is reserved to the Courts.
12. LegalMatters.com performs assignments with due care and accuracy, as befits a good Contractor.
13. LegalMatters.com B.V. is not liable for any damage unless directly resulting from demonstrable gross negligence or a deliberate act by LegalMatters.com B.V.
14. Any compensation is limited to the invoice of the month in question, and in any case to the amount paid under professional liability insurance.
15. LegalMatters.com B.V. is not liable for damage resulting from missed deadlines, nor for consequential losses, loss of profits or indirect losses.
16. LegalMatters.com B.V. is not liable for damage to or loss of property or data made available by the client.
17. Third parties: LegalMatters.com B.V. is not liable for damage caused by third parties selected at the client's request. A 20% margin is charged on third-party invoices to cover administrative and financial risks.
18. When engaging third parties, LegalMatters.com B.V. consults with the client where possible and selects third parties with due care.
19. Engagements are carried out exclusively for the benefit of the client. Third parties cannot derive any rights from work performed for the client.
20. If the client makes work details available to third parties, the client must notify that third party that the work is subject to these General Conditions. Third parties may not use the information without LegalMatters.com B.V.'s prior written consent.
21. Rates & payment: The client accepts that LegalMatters.com B.V. may change its rates. If the client withdraws an assignment before completion, a reasonable fee of at least 75% of the invoice amount is due.
22. LegalMatters.com B.V. invoices monthly with a 14-day payment term. The client must object in writing within 30 calendar days of the invoice date, failing which the performance and invoice are deemed accepted.
23. LegalMatters.com B.V. may request advance payment. Late payment results in default by operation of law, with 1% default interest per month (or part thereof).
24. For consumer-debtors, collection costs are charged in accordance with the Besluit Vergoeding voor buitengerechtelijke Incassokosten.
25. For legal entities or persons acting in a professional or business capacity, actual extrajudicial and other collection costs are claimed, or an amount in accordance with Rapport Voorwerk II.
26. In the event of non-payment or late payment, LegalMatters.com B.V. has the right to suspend or terminate work. Advance payments may be offset against unpaid invoices.
27. Applicable law: The agreement between client and LegalMatters.com B.V. is governed exclusively by Dutch law. Disputes are settled exclusively by the competent Dutch court.
28. These general terms are a translation of the Dutch general terms. In case of any difference, the Dutch general terms prevail.
